1. Acceptance of Terms
By accessing or using Archivarix Tube Search ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.
2. Service Description
Archivarix Tube Search is an independent research and archival tool that provides a search interface for discovering and browsing video metadata sourced from publicly available web archives, including the Internet Archive (Wayback Machine), Common Crawl, and publicly released research datasets. The Service does not host, stream, reproduce, or distribute any copyrighted audio or video content. The Service displays only textual metadata (titles, descriptions, dates, channel names) and text-based subtitle transcriptions that have been previously captured and made publicly available by third-party web archiving projects. All videos displayed in search results link directly to their original YouTube page.
3. User Accounts
You may create an account to access additional features. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must provide accurate information and update it promptly if it changes. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscriptions and Payments
The Service offers optional paid subscriptions ("Plus") that provide enhanced search capabilities, higher usage limits, and additional features such as CSV export and bulk operations. Subscription fees cover the cost of operating and maintaining the Service infrastructure, including servers, storage, bandwidth, and development. Subscriptions do not grant ownership of or exclusive access to any third-party data.
5. Acceptable Use
You agree not to: (a) use the Service for any purpose that violates applicable law; (b) attempt to circumvent rate limits, access controls, or other technical restrictions; (c) scrape, crawl, or access the Service through automated means beyond normal browser use without prior written permission; (d) interfere with the operation of the Service or other users' access; (e) use data obtained from the Service to harass, stalk, or harm any person; (f) misrepresent your identity or affiliation; (g) redistribute or commercially exploit data obtained from the Service in bulk without permission.
6. Intellectual Property
The Service's source code, design, branding, and original content are the property of Archivarix. Video metadata, thumbnails, and subtitle text displayed through the Service originate from third-party public archives and are presented solely for informational, research, and archival purposes. We make no claim of ownership over any third-party content. YouTube and the YouTube logo are registered trademarks of Google LLC. All other trademarks belong to their respective owners.
7. Content Removal (DMCA / Takedown)
We respect the intellectual property rights of others. If you are a rights holder (or authorized agent) and believe that metadata or subtitle text displayed on the Service infringes your copyright or other rights, you may submit a removal request to us at the contact address below. Your request should include:
- Identification of the copyrighted work;
- Identification of the material on our Service that you claim is infringing, with sufficient detail to locate it;
- Your contact information;
- A statement that you have a good-faith belief that use of the material is not authorized;
- A statement, under penalty of perjury, that your notice is accurate and that you are authorized to act on behalf of the rights holder.
We will review and respond to valid removal requests promptly.
8. Archival and Research Purpose
The Service is designed for research, educational, and archival purposes. The data indexed by the Service has been previously collected and made publicly available by recognized web archiving organizations (Internet Archive, Common Crawl) operating under their own terms and legal frameworks. The Service acts as a search index over this pre-existing public data and does not independently collect data from YouTube or any other video platform.
AI-Generated Video Summaries
The Service offers AI-generated summaries of YouTube videos ("Summaries"). These Summaries are created automatically by artificial intelligence based on publicly available video transcripts (subtitles). By using this feature, you acknowledge and agree to the following:
- No claim of ownership. We do not claim any ownership of the original video content, including its audio, visual, or textual elements. All rights to the original video belong to its respective creators, uploaders, and rights holders.
- Transformative purpose. Summaries are produced as a convenience tool to help users quickly understand the content of a video. They serve an informational, educational, and research purpose and are not intended to replace, reproduce, or substitute the original video.
- Not a verbatim copy. Summaries are machine-generated interpretive abstractions of the video's transcript. They are not literal reproductions of the original content and may differ significantly from the source material in wording, structure, and emphasis.
- No warranty of accuracy. Summaries are generated by AI and are provided "as is" without any warranty of accuracy, completeness, or reliability. They may contain errors, omissions, misinterpretations, or hallucinated content. Users should not rely solely on Summaries for decision-making.
- Content removal. If you are a rights holder and believe that a Summary on the Service infringes your rights or misrepresents your content, you may request its removal by contacting us at the address provided in the Contact section below. We will review and process valid removal requests promptly.
- Usage limits. Summary generation is subject to daily usage limits that vary by subscription tier. Failed generation attempts (due to errors or unavailable subtitles) do not count toward your daily limit.
- User responsibility. You are responsible for how you use, share, or redistribute AI-generated Summaries. You must not present Summaries as your own original work or as an authoritative source.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy, completeness, timeliness, or availability of any archived data. Web archives may contain incomplete, outdated, or inaccurate information.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Archivarix and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or in connection with your use of or inability to use the Service, regardless of the theory of liability.
11. Indemnification
You agree to indemnify and hold harmless Archivarix and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. You may stop using the Service at any time. Upon termination, provisions that by their nature should survive (including limitations of liability, indemnification, and intellectual property) will remain in effect.
13. Governing Law and Dispute Resolution
These Terms shall be interpreted in accordance with general principles of international commercial practice. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration under the rules of a mutually agreed arbitration body, or, if no agreement can be reached, to the competent courts of the jurisdiction where Archivarix maintains its principal place of business.
14. Changes to Terms
We may update these Terms at any time by posting the revised version on the Service. The "Last updated" date at the top indicates when the Terms were last revised. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
